法律翻译不同于文学翻译,它追求译文的准确和一致,因此法律翻译对等是法律翻译研究中的一个重要内容。法律翻译是一种跨法系和跨语言的语码转换,它涉及语言、法律、社会和历史等诸多因素,绝对对等的法律翻译是理想化的。本研究视法律翻译为一个语用的过程,探讨影响目的语读者理解法律源文本的各项因素,并提出最大限度促进对等呈现的措施。
Achieving an equivalent translation is the target of legal translation. But as the legal translation is the translation between both legal systems and language systems involving factors such as language, law, society and history, it is impossible to achieve absolute equivalent legal translation. Legal translation shall be seen as a pragmatic process and TT readers' comprehension is the key element for achieving the equivalence, so factor that influence the pragmatic process of legal translation shall be studied carefully.
