法律翻译在涉外法治建设中扮演着至关重要的角色,是法律知识跨法系、跨语系传播的桥梁。从知识翻译学的视角出发,法律翻译不仅涉及法律语言文化的加工、重构与传播,还体现了地方性法律知识的迁徙与交融。语言是法律的载体,语言也是表述法律的工具。法律语言中有些词汇自古沿用至今,这种现象普遍存在于各国的法律语言中。在法律语言中,古英语词的使用比较普遍,体现法律的正式性、权威性,同时也增加了翻译的复杂性。论文从知识翻译学的视角研究古英语词中知识的翻译与翻译的知识。其中知识的翻译层面即语言知识层,包括古英语词中的知识精确性、知识正式性、知识历史性以及知识逻辑性;翻译的知识层面即技术知识层,包括直译、增译、省译与意译的翻译方法与技巧。最终目标是搭建一个知识的翻译与翻译的知识良性互动的界面,为法律英语翻译提供全方位、多层次的知识支持。

Legal translation holds a pivotal position in the development of the international rule of law, functioning as a channel for the cross-legal system and cross-language communication of legal knowledge. From the perspective of Transknowletology, legal translation encompasses not only the processing, reconstruction, and communication of legal language and cultural elements, but also manifests the transformation and integration of knowledge localization. Language serves as the medium through which law is articulated and preserved. Certain legal terminology has persisted since ancient times, which is a phenomenon ubiquitous across legal languages globally. The use of Archaic Words within legal language is particularly prevalent, underscoring the formality and authority of the law, which makes them harder to translate. This paper delves into the translation level of knowledge and the knowledge level of translations embedded in Archaic Words from the perspective of Transknowletology. The former, the translation level of knowledge, pertains to the language knowledge level, which encompasses precision, formality, historicity, and logical coherence in Archaic Words. The latter, the knowledge of translation, aims to the skills knowledge level, including translation methods, such as literal translation, free translation, and addition and omission. The goal is to forge an interface that fosters a positive interaction between the translation level of knowledge and the knowledge level of translation, thereby furnishing comprehensive and multilevel knowledge support for legal English translation endeavors.
